In the Marion Circuit Court IN THE MATTER OF REMONSTRANCE AGAINST THE ANNEXATION OF THE TOWN OF BROAD RIPPLE TO THE CITY OF INDIANAPOLIS. Remonstrance. To the Judge of the Marion Circuit Court. We, the undersigned, representing to the court that we are residents and qualified votes of Marion County, State of Indiana; that we and each of us reside in and are qualified voteers of what was known and designated as the Town of Broad Ripple, in said Marion County prior to the passage of an ordinance by the Common Council of the City of Indianapolis, in said Marion County, which ordinance was passed by the Common Council of said City of Indianapolis on the 19th day of June, 1922, a copy of which ordinance is attached hereto and made part hereof and marked "Exhibit A". That by the terms of said ordinance said City of Indianapolis seeks to and does annex unto itself all that territory embraced within the corporate limits of said Town of Broad Ripple. Now therefore, we, the undersigned residents and qulified voters aforesaid, hereby remonstrate against the annexation of said Town of Broad Ripple by said City of Indianapolis, and as reasons for such remonstrance say: 1. That by such annexation, the debt of the said City of Indianapolis would become a part of the debt to be assumed by said district heretofore embraced with the corporate limits of said town of Broad Ripple, without corresponding advantages to be gained by said district. 2. That the district heretofore embraced within the corporate limits of the Town of Broad Ripple aforesaid is peculiarly located, in that the said Town of Broad Ripple is a high-grade residential district; that White River flows through and along said district; that along said river are numerous resorts of a public and semi-private nature; that the river is an attraction for the persons of all classes and conditionsl that the undersigned, as residents and voters of said district believe that the local government of the Town of Broad Ripple is more qualified to govern and control the conditions that arise from such situations with respect to the best interest of the community, than would be the officials of the city of Indianapolis. 3. That the administration of the affairs of that district heretofore embraced within the corporate limits of said Town of Broad Ripple under the City of Indianapolis, will cause the tax payers of sych district to pay a much higher rate of tax than they would pay should annexation not prevail, without corresponding benefit to such district. Wherefore the undersigned remonstrate against such annexation and pray the court that in justice such annexation should not take place. SPECIAL ORDINANCE NO. 2, 1922 AN ORDINANCE annexing certain territory to the City of Indianapolis, Indiana, and defining a part of the boundary line of said City, and fixing a time when the same shall take effect. BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF INDIANAPOLIS, INDIANA: Section 1. That the City of Indianapolis be and the same is hereby extended so as to include the following described continuous territory all of which is hereby annexed to and made a part of the territory constituting and forming the City of Indianapolis, in Marion County, Indiana. Section 2. Beginning at a point where the south line of 54th Street (formerly known as 52nd Street) intersects with the right of way line of the Chicago, Indianapolis and Louisville Railroad Company; Thence north with the east right of way line of the aofresaid railroad company to the south link of section 36, township 17 north, range 3 east; thence east and alongthe south line of said section to the center line of Compton Street; thence north with the center line of Compton Street to the center line of 63rd Street (formerly known as Shelby Street); thence east with the center line of 63rd Street, a distance of five hundred fifty-five (555) feet more or less; thence south to the south line of Section 36 township 16 north, range 3 east; thence east with said section line a distance of one hundred ninety-thre and thirty-six one hundredths (193.36) feet more or less; thence north to the center line of 63th Street; thence east and southeast with the center line of 63rd Street to the center line of Ralston Drive; thence south with the center line of Ralston Drive, a distance of one thousand four hundred sixty-four and ninety-five one-hundreths (1464.95) feet; thence wast one thousand three hundred thirty-nine and fifty one hundredths (1339.50) feet to the center line of Evanston Avenue; thence north with the center line of Evanston Avenue to the center line of 63rd Street, which is also the south line of section 36, township 17 north, range 3 east; thence west with said section line a distance of one thousand one hundred eighty-five and eighty-four one hundredths (1185.84) feet more or less; thence north and parallel with the east line of said section a distance of five hundred seventy and nine-tenths (570.9) feet more or less; thence wast and parallel with the south line of said section five hundred seventy and twenty-four one hundredths (570.24) feet more or less; thence north and parallel with the aast line of said section one thousand three hundred and ninety and with one-hundreths (1390.08) feet more or less; thence west and parallel to the south line of said section, four hundred and fifty-one (451) feet; thence south and parallel to the east line of said section, two hundred twenty- six and five tenths (226.5) feet; thence west and parallel to the south line of said section three hundred and fifty-three and one-tenth (353.1) feet to the low water mark of the White River; thence wouth along the low water mark of the White River, four hundred fifteen (415) feet more or less to the south line of the north half of the south east quarter of said section; thence west with the aforesaid line of and across White River to the west line of the Indianapolis Water Company's property; then southwest with the said property line to the southeast corner of H. P. Dawson's property; thence north fifty-six (56) degrees west to a point, said point being the low water mark on the west side of White River; thence following the low water mark of the White River to a point, said point being where the west line of College Avenue extended north would intersect with the low water mark on the south side of White River; thence south with the west line of College Avenue, to a point fifteen (15) feet north of the south line of Central Canal; thence southwest and parallel to and at a uniform distance of fifteen (15) feet north from the north line of the Central Canal to a point, said point being opposite the west line of the first alley east of Central Avenue, as the same extended north from 61st street; thence east with the south line of 61st street to the west line of the first alley east of Central Avenue; thence south with the said west line to the north line of 54th Street; thence west with the north line of 54th street to the east line of Central Avenue; thence south with the east line of Central Avenue to a point, said point being seventy-one and two tenths (71.2) feet south of the south line of 54th street; thence east and parallel to and a uniform distance of seventy one and two-tenths (71.2) feet south of the south line of 54th street to the east line of College Avenue; thence north and along the east line of College Avenue; thence north and along the east line of College Avenue to the south line of 54th Street, thence east and along the south line of 54th Street to the point of beginning. Section 3. This ordinance shall be in full force and effect from and after its passage.
